July 30, 2026. Senior Associate Samantha Feinberg obtained a favorable verdict for her client in a 2-day jury trial in Jackson County, Georgia. The suit arose from a severe front-end impact where the Defendant crossed into Plaintiff’s lane of travel. The Defendant subsequently pled guilty to driving under the influence of alcohol in conjunction with the collision. This was his first criminal conviction aside from a simple traffic ticket. The Defendant admitted negligence for causing the collision at trial.

The Plaintiff was driven to the hospital from the scene and admitted overnight for serious injuries. He underwent treatment and was out of work for three months following the collision. He also claimed to be unable to continue in his field of work, a blue collar position, permanently.

In closing, the Plaintiff’s attorney attempted to inflame the jury’s emotions using the criminal conviction, ultimately asking the jury for past medical bills of $44,000, $12,000 in lost wages, $150,000 for attorney’s fees, $150,000 for past pain and suffering, and an unspecified amount for future pain and suffering. He additionally asked the jury to find that the Defendant was liable for punitive damages.

After deliberation, the jury returned a total verdict of $107,000. Further, the jury did not find the Defendant liable for punitive damages or attorney’s fees. This was well less than the plaintiff’s last offer of Settlement of $350,000.
