Joseph Kaiser, Managing Partner of Groth, Makarenko, Kaiser & Eidex, co-presented “Who Speaks for the Corporation? The 30(b)(6) Through the Eyes of Counsel and the Company” at the 2026 Insurance Law Institute sponsored by the State Bar of Georgia. Joined by Jeremy Hayes, Senior Counsel at Georgia Power Company, Kaiser offered practical guidance on corporate representative depositions from the perspectives of defense counsel and the company.

Jeremy Hayes and Joseph Kaiser (L-R) present at the 2026 Georgia Insurance Law Institute.
“Preparing a corporate representative for deposition requires close coordination between defense counsel and the company, with careful attention to both litigation objectives and business responsibilities,” said Kaiser. “I welcomed the opportunity to present alongside Jeremy Hayes and discuss this important aspect of corporate representation with Georgia’s insurance defense attorneys and industry leaders.”
Federal Rule of Civil Procedure 30(b)(6) allows a party to identify deposition topics and requires the organization receiving the deposition notice to designate one or more representatives to testify on its behalf. The presentation focused on the core tension associated with a 30(b)(6) procedure, which is that the rule asks one human being to answer, under oath and on the record, for knowledge scattered across the entire organization.
The presentation covered six key points, including a comparison of Federal Rule 30(b)(6) with Georgia § 9-11-30(b)(6), how to evaluate and respond to the notice, selecting the designees, preparing the witness, defense guidance during the deposition, and practical insights from real-life experiences to help attendees strengthen their deposition defense strategies.
