Attorneys Nathan Azarowicz and Kelvin Hosken Obtain Summary Judgment

January 30, 2026.  GMKE Attorneys Nathan Azarowicz and Kelvin Hosken obtained Summary Judgment in favor of their clients in the State Court of Gwinnett County.  Mr. Azarowicz actually prevailed on two separate dispositive motions in this case.  The case arose out of an automobile accident that allegedly occurred on April 25, 2022, initially bringing suit against one Defendant alleging that Defendant rearended her.  That Defendant denied being involved in any accident, contending she was at work at the time of the accident and nowhere near the alleged site of the accident. Thus, there was a significant liability dispute.

Regarding the first Motion, after depositions were taken, the Plaintiff changed her testimony to allege that it was a man that had rear ended her (the original Defendant was a woman).  After this, Plaintiff’s counsel filed a motion to add the Defendant’s Husband to the lawsuit. Plaintiff was never successful in serving Defendant Husband before the statute of limitations. Through a motion to dismiss based on the failure to timely serve him, he was dismissed from the case.  This left only the Plaintiff with her case against Defendant Wife.

In the Second motion, Mr. Azarowicz and Mr. Hosken filed a Motion for Summary Judgment as to the claims against remaining Defendant.  In their motion, they argued that the only evidence that Plaintiff presents to show Defendant was driving at the time of the collision is an expired Insurance Card that at some time belonged to the Defendant. Further, that in Plaintiff’s own sworn deposition testimony she stated that she did not remember the accident, and the driver of the vehicle that rear-ended her was a “Caucasian man”, not a woman.  The Defendant’s Motion for Summary Judgment was granted by Judge Jaletta Smith of the State Court of Gwinnett County.

The case is Velicia Jordan v. Jeri Lynn Ellenberg and William Randy Ellenberg, State Court of Gwinnett County, CAFN 24-C-02700-S7.
