November 15, 2022 – Associate Attorney Regina M. Taylor won a dismissal on behalf of an insured driver in Fulton County.
The case arose out of a motor vehicle accident that occurred on March 25, 2017. Plaintiff alleged injuries from the rear end loss and filed suit against Ms. Taylor’s client on March 24, 2019. Plaintiff failed to properly serve the Defendant until September 6, 2022, well after the statute of limitations had expired. Ms. Taylor filed a notice of Special Appearance Answer, raising the appropriate legal defenses, and Motion to Dismiss on behalf of the Defendant in October of 2022.
The statute of limitations had long expired before Defendant was actually served. Ms. Taylor filed a Motion to Dismiss on behalf of the Defendant, arguing that Plaintiff failed to exercise the greatest possible diligence in serving the Defendant. Plaintiff responded to Ms. Taylor’s motion requesting denial of Defendant’s motion and an oral argument. The Motion to Dismiss was granted and Plaintiff’s request was denied.
