April 20, 2022 – Associate Ryan O. Bell Wins Motion to Dismiss in the State Court of DeKalb County in a case involving a dispute as to whether the Plaintiff exercised the required diligence in attempting to perfect timely service.
This case arose from an automobile accident that took place on March 30, 2018.
Mr. Bell argued that since personal service had never been perfected on his client within the applicable period of the statute of limitations, and Plaintiff failed to make reasonable and diligent efforts to effect service, the case should be dismissed. Plaintiff failed to meet the burden of proof demonstrating that she had made diligent efforts to perfect service, and Judge Kimberly A. Alexander entered an Order of Dismissal with Prejudice on April 12, 2022.
